RULES

The following are the terms and conditions for making purchases and using services electronically via the www.beatamrotek.com website.

I. Definitions

  • Seller/Service Provider: Beata Mrotek English Coaching ul. Zamiejska 7, 05-802 Pruszków, NIP 6311261119, Regon 146435443
  • Rules: these Rules. With regard to services provided by electronic means, these Rules are the rules referred to in Article 8 of the act of 18 July 2002 on the provision of services by electronic means (Dz.U. z 2002 r., Nr 144, poz. 1204, as amended).
  • Customer: a natural person (including a consumer), a legal person and an organisational unit which is not a legal person but to which special rules grant legal capacity, who/which concludes a Sales Contract, also at a distance, or uses other Services of the E-Shop.
  • Consumer: a natural person who concludes a Sales Contract for the purpose directly connected with his/her business or professional activity.
  • Service: the service provided by the Service Provider to the Customer.
  • Product: the goods and services listed, described and presented on the Website.
  • Sales Contract: an contract for the sale of Products within the meaning of the Civil Code, concluded between the Seller and the Customer, using means of distance communication.
  • Website: the website at www.beatamrotek.com, through which the Customer can purchase a Product.
  • Parties: the Service Provider and the Customer.
  • Order: the Customer’s declaration of intent specifying unambiguously the type and quantity of Products, aiming directly at the conclusion of a Distance Sale Contract via the Website.

II. General principles

  1. The Terms and Conditions set out the rules for the sale of Products via the Website, either verbally or in writing, and the mutual rights and obligations of the Parties in connection therewith.
  2. The Terms and Conditions are made available to the Customer on the Website, in a form that allows the Terms and Conditions to be obtained, reproduced and recorded by means of the ICT system used by the Customer.
  3. As a condition of placing an Order, the Customer is required to read and accept these Terms and Conditions.
  4. By placing an Order on the Website, the Customer is deemed to have read, accepted and complied with the provisions of these Terms and Conditions.

III. Products offered

The Products offered on the Website are:

  1. Analysis of professional predispositions carried out on the basis of Career Direct tests (known in Poland as Career Compass) in three variants described at www.beatamrotek.com.
    1. Educational test
    2. Professional test
    3. Premium vocational test
  2. Demonstration coaching session of 30 minutes.

IV. Technical requirements

  1. Your browser should have javascript and cookies enabled.
  2. In order to use shopping on the Website, it is necessary for the Customer to have an active electronic mail (email) account.
  3. During the shopping on the Website, small cookie files are installed on the Customer’s ICT system for identification purposes and for statistical purposes, if the browser the Customer uses so permits.
  4. The Seller has an SSL security certificate for the domain beatamrotek.com
  5. The Seller shall make every effort to ensure that use of the Website is possible from all common types of computers, operating systems and Internet browsers, but does not guarantee and is not responsible for the possibility and effectiveness of using the said pages in whole or in part using all available tools.
  6. The protection of the Customer’s personal data is provided in accordance with the principles set out in the Privacy Policy published on www.beatamrotek.com.
  7. The Seller shall make every effort to ensure that the Website is available at all times and in full.
  8. The Customer may not post content on the Website that is unlawful, immoral or contrary to the rules of social conduct.

V. Placing and accepting Orders

  1. The Customer places an Order on the Website by:
  2. a) selection of one or more items of Products offered on the Website,
    b) proper completion and submission of the electronic order form,
  3. c) making payment in the Tpay system (www.tpay.com), whose operator is Krajowy Integrator Płatności S.A. with the seat in Poznań, Plac Andersa 3, 17th piętro, 61-894 Poznań, NIP 7773061579, REGON 300878437
  4. Orders can be placed 24/7, as long as the Website is not offline due to periodic maintenance work.
  5. An order will be deemed to have been placed if the order form contains all the data which allows the Customer to be correctly identified, including in particular a contact phone number or email address. If the data provided is not complete, the Seller will contact the Customer. If it is not possible to contact the Customer, the Seller has the right to cancel the Order.
  6. The Seller confirms the placement of an Order for a Career Compass by automatically sending an email with all the information provided in the form.
  7. After sending the Order for the selected package of the Career Compass, the Customer is automatically redirected to the tpay.com payment system in order to make the payment. The Customer will receive a confirmation of the correctly completed payment to the indicated email address.

VI. Payment terms and forms

  1. All prices presented on the Website are in Polish złoty (PLN) and are VAT exempt. The price shown next to each Product is binding at the time of placing the Order.
  2. For each Product sold, the Seller shall issue a proof of purchase (invoice) upon the Customer’s request.
  3. The Customer agrees to issue and send electronically, to the email address stated by the Customer, electronic images of settlement documents, in particular such as invoice, correction invoice. This consent also authorises the Seller to issue and send invoices in electronic form in accordance with the Regulation of the Minister of Finance of 17 December 2010 on sending invoices in electronic form, the rules of their storage and the manner of making them available to the tax authority or tax inspection authority.
  4. The following forms of payment are available:
    1. Standard bank transfer
    2. Online instant transfer
    3. BLIK
    4. Electronic wallets (Google Pay, Visa Checkout, Masterpass, PayPal)
    5. Payment card (debit or credit)

VII. Withdrawal from the Contract

  1. A Consumer who has concluded a distance contract has the right to withdraw from the contract without stating a reason by making a statement in writing within 14 days of the conclusion of the contract (legal basis: Article 7.1 of the act of 2 March 2000 on the protection of certain consumer rights and liability for damage caused by dangerous products, Dz.U. Nr 22, poz. 271, as amended). It is sufficient to send the declaration before the end of this time limit. In the event of withdrawal from the contract, the contract shall be deemed not concluded and the consumer shall be released from all obligations. What the Parties have rendered shall be returned unchanged. The refund of the fee for the Career Compass package should be made immediately, not later than within fourteen days.
  2. The cancellation provisions described in paragraph 1 above do not apply if the Consumer, after receiving the registration link from the Seller, creates an account in the system on careerdirect.org to start the test.
  3. The right of withdrawal referred to in paragraph 1 shall apply to consumer sales and shall therefore only apply to Customers who are consumers.
  4. A consumer is not entitled to withdraw from a distance contract in cases of service provision commenced, with the consumer’s consent, before the lapse of the 14-day period referred to in Article 7.1 of the act of 2 March 2000 on the protection of certain consumer rights and liability for damage caused by a hazardous product, Dz.U. Nr 22, poz. 271, as amended.

VIII. Complaints

  1. Complaints should be submitted in writing (by letter, email) to the address: Beata Mrotek ul. Zamiejska 7, 05-802 Pruszków or by email to hello@beatamrotek.com.
  2. The complaint is dealt with within 14 days of receipt by the Seller.
  3. The provisions of the act of 27 July 2002 on specific terms and conditions of consumer sales and amendments to the Civil Code (Dz.U. Nr 141, poz. 1176, as amended) and the act of 2 July 2000 on the protection of certain consumer rights and liability for damage caused by dangerous products (Dz.U. z 2000 r., Nr 22, poz. 271, as amended) shall apply to complaints and the Seller’s liability for non-compliance of Goods with the contract in relation to consumers.
  4. In the case of non-consumer sales, the provisions of articles 556 to 576 of the Civil Code are excluded, to the exclusion of mandatory provisions.

IX. Privacy Policy

  1. When placing an Order, the Customer must consent to the inclusion of his/her personal data in the database of the Seller’s Website for processing in connection with the execution of the Order. The Customer has the right to inspect his/her data, correct it and request its deletion.
  2. Providing the Customer’s data only serves the purpose of fulfilling the Order. The controller of personal data processed in connection with the processing of the Order is Beata Mrotek English Coaching ul. Zamiejska 7 05-802 Pruszków, NIP 6311261119, Regon 146435443.
  3. The Customer’s personal data are stored in the Seller’s IT system for the duration of the Order processing procedure.
  4. Detailed rules for the protection and processing of personal data are described in the Privacy Policy available on www.beatamrotek.com.

X. Final provisions

  1. In matters not governed by these Rules, the provisions of the act of 2 March 2000 on the protection of certain consumer rights and liability for damage caused by dangerous products (Dz.U. z 2000 r. Nr 22 poz. 271 as amended), the act of 27 July 2002 on special conditions of consumer sale and amending the Civil Code (Dz.U. z 2002 r. Nr 141 poz. 1176 as amended), the act of 23 April 1964 on the Civil Code (Dz.U. z 1964 r. Nr 16 poz. 93 as amended).
  2. Disputes arising from the application of these Terms and Conditions and in relation to the performance of the concluded Sales Agreements between the Seller and the Customers:
    i. who are consumers, will be considered by the court having jurisdiction according to the provisions of the material and local jurisdiction in accordance with the act of 17.11.1964 on the Code of Civil Procedure (Dz.U. Nr 43, poz. 296, as amended),
    ii. who are not consumers, will be considered by the court having jurisdiction over the place of the Seller’s seat.
  3. The Seller reserves the right to amend these Terms and Conditions provided that Sales Agreements concluded prior to amendment of the Terms and Conditions shall be governed by the version of the Terms and Conditions in force at the time of conclusion of the Sales Contract.
